Federal Judge Tears Into DOJ Over January 6th: Treatment of Rioters “Almost Schizophrenic”

Chief District Court Judge Beryl Howell, an Obama appointee to the District Court in Washington, D.C., is not pleased with the treatment of Jan 6 rioters by the DOJ.

Unlike the judge who was concerned about civil rights violations, Howell is concerned with the rioters getting off too easy. She's definitely been reading every headline about the events of Jan 6 because she finds there's a severe disconnect between the "extreme terms" with which the DOJ describes the event and the plea agreements being made with rioters for second-tier misdemeanors.

Howell says the treatment is "almost schizophrenic". "This is a muddled approach by the government […] I'm trying to make sense of the government's position here."

Howell would probably rather the charges aligned with the rhetoric surrounding Jan 6, but that's not all. It's her position that all participants, even those who never stepped foot into the capitol building, should be considered "enablers of an assault against the republic." What would one expect from an Obama judicial appointee?

For her part, Howell has pressed prosecutors "to consider the broader threat to democracy" those charged with trespassing represent. She sounds like one who has been gulping down the media Kool-Aid. But even with her huffing and puffing, most people charged have been pleaded out, receiving relatively modest fines or probation.

As most of us knew in the beginning, little was done in the way of violence by the rioters, nor was there much in the way of additional crimes committed past trespassing. The rhetoric may be something one might hear from the soapbox of a doomsday prophet on a street corner, but the reality is quite different, and the charges being handed out seem to coincide with the reality, much to the consternation of those like Judge Howell.
